대한민국: 경찰이 표현의 자유를 침해하고 있다

The sister organisation of the Asian Legal Resource Centre (ALRC), the Asian Human Rights Commission (AHRC), and the Asian Forum for Human Rights and Development (FORUM-ASIA), conducted a joint fact-finding mission in Seoul, South Korea, from July 21 to 24, 2008. The primary purposes of the mission were to examine the situation of human rights defenders and the state of freedom of opinion and expression in light of the candlelight vigils held to protest against the agreement between the United States and South Korea to lift U.S. beef import restrictions. These vigils, in relation to which 1,524 people have been arrested and over 2,500 have been injured as of August 22, continue to date.

아시아법률구조센터(ALRC)의 자매 기구인 아시아인권위원회(AHRC) 및 인권과 개발에 관한 아시안 포럼(FORUM-ASIA)는 2008년 7월21-24일 대한민국 서울에서 공동조사를 실시했다. 이번 임무의 주요 목적은 미국소 수입규제 해제에 관한 한국과 미국의 협정에 대한 항의로 진행된 촛불시위 중 인권 상황과 의견개진 및 의사표현의 자유의 상태를 조사하기 위한 것이었다. 8월 22일 현재 1524명이 체포되고 2500명 이상이 부상당한 이번 촛불시위는 아직도 계속되고 있다.

The evidence gathered shows that there have been numerous attacks against human rights defenders participating in the daily vigils that began on May 2, 2008. There is a trend towards unduly limiting freedom of opinion and expression, particularly in the media and the internet.

수집된 증거를 살펴볼 때 2008년 5월 2일 시작된 촛불시위에서 수많은 인권침해 사례가 발견됐다. 특히 언론과 인터넷에서 의견개진 및 의사표현의 자유가 과도하게 제한되는 경향을 보였다.

The ALRC and FORUM-ASIA are concerned that, based on the evidence gathered, most of the attacks against human rights defenders and protesters participating in the candlelight vigils were committed by riot policemen. Testimony from the eight NGOs, 12 human rights defenders and the National Human Rights Commission of Korea (NHRCK) that the mission interviewed, as well as videos available on the internet (please see http://kr.youtube.com/watch?v=XxYG3zxJT7g&feature=related, http://www.youtube.com/watch?v=EZ3Peq7lbjY&feature=related), reveal numerous unwarranted attacks on unarmed demonstrators that were often ordered by riot police commanders.

수집된 증거에 기초해 ALRC와 FORUM-ASIA는 촛불시위 참가자들에 대한 인권 침해 사례의 대부분이 경찰에 의해 자행됐다는 점에 우려를 표한다. 이번 조사 중 면담한 8개 NGO, 12개 인권단체 및 국가인권위원회(NHRCK)의 증언 및 인터넷에서 확인한 자료(http://kr.youtube.com/watch?v=XxYG3zxJT7g&feature=related, http://www.youtube.com/watch?v=EZ3Peq7lbjY&feature=related 참조)를 볼 때 주로 진압경찰의 지시에 의해 비무장 시위대에 대해 부당한 공격이 여러 차례 자행된 것으로 나타났다

Moreover, evidence shows that the riot police deployed during these vigils are violating principles of international law in their use of such tools as water cannons. Under the Basic Principles on the Use of Force and Firearms by Law Enforcement Officials, governments should “develop non-lethal incapacitating weapons for use in appropriate situations, with a view to increasingly restraining the application of means capable of causing death or injury to persons." ¹ Water cannons may be deemed as "non-lethal incapacitating weapons” meant to control a violent mob. However, it should be noted that the riot police during these vigils train the water cannons on peaceful crowds. Moreover, water cannons are blasted at full force and at close range directly at the demonstrators, resulting in injuries to people's ears, eyes, and faces. It is worth noting that in the manual of the National Police Agency of South Korea, water cannons may only be directed at a crowd at a 15 degree angle and only used on people about 20 metres away.

게다가 증거자료들을 볼 때 진압경찰은 촛불시위 과정에서 물 대포 등 도구를 사용하는 등 국제법의 원칙을 위반하는 행위를 자행했다. 법집행관에 의한 무력 및 화기사용에 관한 기본 원칙(Use of Force and Firearms by Law Enforcement Officials)에 따라 정부는 “사람들을 죽게 하거나 다치게 할 수 있는 도구 사용을 점진적으로 제한한다는 입장을 견지하며 적절한 시점에 사용할 수 있는 치명적이지 않은 진압무기를 개발”해야 한다. 물대포는 폭도들을 제압하는 “치명적이지 않은 진압 무기”로 간주될 수는 있다. 하지만 진압경찰은 촛불시위 중 평화로운 군중에 대해 물대포를 겨누었다는 사실에 주의해야 한다. 게다가 최대 수압으로 가까운 거리에 있는 시위대에게 직접 물대포를 발사함으로써 시위대의 귀, 눈, 얼굴 등에 부상을 입히는 결과가 나타났다. 경찰수칙에 따르면 물대포는 사람들이 20미터 밖에 있을 때 15도 각도로 발사하도록 돼 있다는 점에 주의할 필요가 있다.

The Basic Principles on the Use of Force and Firearms by Law and Enforcement Officials also stipulate that law enforcers should be equipped with self-defensive equipment, such as "shields, helmets, bullet-proof vests," in order to decrease the need to use weapons of any kind. ² However, riot police use their shields, not as a tool for self-defence, but as an additional weapon to hit peaceful participants in the vigils. An example is the attack of riot police ordered by their commander on protesters from the YMCA on June 28 in Seoul. The police hit the demonstrators with their shields and stepped on them even though they were lying on the ground. As a result, the right arm of YMCA secretary-general Lee Hak-yeong was broken, and his associate, Hong Gyeong-pyo, was kicked unconscious.

법집행관에 의한 무력 및 화기사용에 관한 기본원칙은 법 집행 담당자는 어떤 형태의 무기라도 그 사용의 필요성을 줄이기 위해 방패, 헬멧, 방탄조끼 등 자기 방어 장비를 착용하도록 하는 규정을 담고 있다. 하지만 촛불집회에서 진압경찰은 방패를 자기방어를 위한 도구가 아니라 평화로운 시위대를 공격하기 위한 또 다른 무기로 사용했다. 실례로 6월 28일 서울 YMCA에서 지휘관의 지시에 의해 시위대를 공격한 진압경찰의 행위를 들 수 있다. 경찰은 방패를 사용해 시위대를 때리고 시위대가 땅 위에 넘어진 뒤에도 밟는 행위를 자행했다. 그 결과 이학영 YMCA 사무총장의 오른 팔이 부러졌고 홍경표 간사는 발포 채여 의식을 잃었다.

Human rights defenders present during the vigils to ensure the people's right to assemble and express themselves have not been immune from this police violence.

Five NHRCK staff members monitoring the vigil on June 28 were injured by the police after being beaten with batons and hit by metal objects thrown by the police, even though they were clearly identified as members of NHRCK. A three-sided metal object that looked like the rear window frame of an automobile that was thrown at the monitors was shown to the mission by the NHRCK.

인권단체들은 집회 및 표현에 관한 권리를 주장하는 촛불시위가 경찰의 폭력으로부터 안전하지 않다고 밝혔다. 6월 28일 촛불시위를 모니터링하던 한국 국가인권위원회 조사단 5명은 스스로 국가인권위 소속임을 밝혔음에도 불구하고 경찰의 곤봉 경찰이 던진 금속성 물질에 맞아 부상당했다. 국가인원위원회는 모니터링 팀에 날아온, 자동차 뒷 유리창 프레임으로 보이는 금속성 물체를 조

사단에게 보여주었다.

In another incident at about 1:30 a.m. on June 26, Lee Joon-hyung, a lawyer working with MINBYUN-Lawyers for a Democratic Society, an NGO that provides legal assistance to arrested demonstrators, was hit in the forehead with a shield by a riot policeman, knocking him unconscious. He was wearing a vest that clearly identified him as a member of "A Group of Lawyers Monitoring Human Rights Violations."

또 한가지 사례로 6월 26일 새벽 1시 30분께 체포된 시위자들을 돕는 NGO인 민변-민주사회를 위한 변호사 모임-소속 이준형 변호사가 진압경찰의 방패에 이마를 맞아 의식을 잃은 사건을 들 수 있다. 그는 “인권침해 감시단”이라는 글자가 뚜렷이 새겨진 조끼를 입고 있었다.

An internet video journalist wearing a press armband, Mr. Kim of OhmyNews, was hit in the head with a baton and police shield, and his arm was beaten with a baton as he tried to report on the vigil at about 11:00 p.m. on June 28. He was then kicked for approximately five to 10 minutes by riot policemen, before being taken to the hospital in an ambulance for treatment. He required medication for two weeks and was still undergoing physical therapy nearly a month after being assaulted when the mission interviewed him.

6월 28일 밤 11시께 기자 완장을 차고 촛불집회를 취재하던 인터넷 언론인 오마이뉴스 김모 기자는 곤봉과 방패로 이마, 팔 등을 맞았다. 당시 그는 후송용 구급차가 도착할 때까지 5-10분동안 진압경찰의 발길에 구타당했다. 그는 전치 2주의 진단을 받았으며 조사단이 그를 인터뷰할 때 근 한달이 지났음에도 치료를 받고 있었다.

Mr. Pyo, a medical student who volunteered to attend to injured protesters and policemen, was at the vigil on the early morning of June 1 when the police began spraying protesters with fire extinguishers to prevent them from removing a police bus with a rope that had been parked to obstruct them. When the fire extinguishers were empty, the police threw them at the protesters. Mr. Pyo was attending to one unconscious man with a severe head wound whose skull was visible when Mr. Pyo himself, who was wearing a white doctor’s gown, was hit on the back by the police with an empty fire extinguisher.

부상당한 시위대와 경찰을 치료하기 위해 자원봉사로 나선 의대생인 표모씨는 시위대가 로프로 차벽을 치우지 못하도록 경찰이 소화기를 살포하기 시작했던 6월 1일 새벽 촛불시위 현장에 있었다. 소화기 분말이 떨어지자 경찰은 빈 통을 시위대에 던졌다. 표씨는 두개골이 드러날 정도로 다쳐 의식을 잃은 한 사람을 돌봐주고 있던 중 의료용 흰 가운을 입고있던 표씨 자신도 경찰에 의해 빈 소화기 통으로 등을 구타당했다.

The ALRC and FORUM-ASIA believe that the policy of conscripting young men into the riot police to fulfil their 24-month military duty contributes to the police violence described above. Under international law, "governments should ensure that all law enforcement officials are selected by proper screening procedures, have appropriate moral, psychological and physical qualities for the effective exercise of their functions." ³ Young, inexperienced men between the ages of 19 and 23 with limited training are clearly not sufficiently qualified to be deployed into such tense and confrontational situations. Rather, it may be more prudent to have only professional and experienced police officers with better training, which includes human rights courses and the understanding of crowd behaviour, deployed at these rallies and all future public assemblies.

ALRC와 FORUM-ASIA은 24개월간의 병역 이행 대상자들인 젊은이들을 진압경찰로 배치한 정책이 위에 언급한 경찰의 폭력에 일조한 것이라고 믿는다. 국제법에 따르면, “정부는 모든 법 집행관은 정당한 심사과정을 통해 선발되어야 하며 효과적인 임무수행을 위해 적절한 도덕적, 정신적, 신체적 자질을 갖출 수 있도록 보장해야 한다”. 19-23세 사이의 젊고 경험이 부족한, 교육이 결여된 남자들이 긴장되고 대립적인 상황에 투입되기에는 자질이 부족하다는 것은 명백하다. 전문적이고 경험이 많은, 인권 과정 및 군중의 행동에 대한 이해 등에 관한 교육이 잘 된 경찰관들만을 향후 집회에 투입하는 것이 더 신중한 처사일 것이다.

During the mission, the ALRC and FORUM-ASIA also gathered evidence of an increasing crackdown on perceived organisers of these candlelight vigils. At least seven human rights defenders who are leaders of the People's Conference Against Mad Cow Disease, a coalition of 1,700 organisations from throughout the country which have organised the vigils since May 6, have sought refuge at the Jogye Temple, a Buddhist temple in Seoul. Warrants have been issued for their arrest for organising the rallies, and a 24-hour police patrol waits outside the temple to arrest them.

이번 조사기간 동안 ALRC와 FORUM-ASIA은 촛불집회 조직자들에 대한 탄압이 증가하고 있다는 증거를 수집했다. 지난 5월 6일부터 전국적으로 1700여개 단체들이 참가해 만들어진 광우병 시민대책위원회 관계자 최소 7명이 서울 조계사에 피신해있다. 집회 조직과 관련, 그들에 대한 체포영장이 발부된 상태이며 경찰이 이들을 체포하기 위해 24시간 사찰 외부를 경계하고 있다.

They and other organisers have been charged under the Act on Assembly and Demonstration, a law passed in 1962 under the military government of President Park Chung-hee when a night-time curfew was in effect. Among its restrictions on freedom of expression is a prohibition against assemblies at night.

그들 및 다른 관계자들은 통행금지가 실시되던 박정희 군사정권 아래서 1962년 제정된 집회 및 시위에 관한 법률에 의해 혐의가 씌워졌다. 이 법은 심야에 표현의 자유가 금지되는 조항이 있다.

Other vigil organisers charged and arrested under this law include Ahn Jin-geol and Yoon Hee-sook on June 25 and Hwang Soon-won on June 30. They have been held in police custody pending an investigation against them (Ahn was later released on bail on August 11). Under South Korea’s rules of criminal procedure, a person may be held in detention pending an investigation if this person is either a non-permanent resident of the country or there is reason to believe that this person will flee the country or taint evidence against him -- criteria not relevant to the cases of Ahn Jin-geol, Yoon Hee-sook and Hwang Soon-won.

이 법에 저촉됐다는 혐의로 체포된 인사로는 6월 25일 체포된 안진걸씨와 윤희숙씨, 6월 30일 황순원씨 등이 있다. 이들은 구금돼 조사를 받고 있다(안씨는 8월 11일 보석으로 석방됐다). 한국 형사소송법에 따르면 주거가 불명확하거나 도주 또는 증거인멸의 우려가 있을 때 구속 수사할 수 있도록 하고 있다-안진걸, 윤희숙, 황순원씨의 경우와는 상관이 없는 기준이다.

The police also obtained warrants to search the offices of the People's Conference Against Mad Cow Disease and Korea Solidarity of Progressive Movements (KSPM), two organisations perceived by the government to be leading and organising the candlelight vigils. During the search, the police seized and confiscated office computers and paraphernalia related to the vigils, which included placards and banners. More importantly, the police took away two police fire extinguishers that had been thrown at demonstrators and police water bottles. These objects indicated the police station from which the police had been deployed and had been collected at the rallies as evidence for legal action.

경찰은 또 광우병 시민대책위원회와 한국진보연대(KSPM)에 대해 촛불집회를 주도하고 조직한 혐의로 수색영장을 발부 받았다. 수색도중 경찰은 플래카드와 배너 등 촛불과 관련된 사무실 컴퓨터와 소지품까지 압류했다. 중요한 점은 경찰이 시위대에게 던졌던 빈 소화기통과 경찰 물병들까지(대책위가 보관하고 있던) 가져간 점이다. 이 물건들은 경찰서에서 사용하던 것들로 합법적 활동의 증거로 시위현장에서 수집된 것들이다.

The ALRC and FORUM-ASIA believe that the purpose of the arrests and police raids was to give a negative impression to the public about these groups and to instil fear in other groups that are helping to organise the protests. These searches and seizures by the police are also believed to be aimed towards instilling fear in the public and discouraging people from joining the vigils.

ALRC와 FORUM-ASIA은 체포행위와 경찰의 급습행위들의 목적이 시민들에게 이들 단체들에 대한 나쁜 인상을 심어주고 시위자들을 돕고있는 다른 단체들에게 위협감을 심어주기 위한 것이라고 믿고있다. 경찰의 압수 수색은 시민들에게 공포감을 심어주고 촛불집회에 참가하려는 시민들을 위축시키기 위한 것으로 보여진다.

Curtailment of freedom of expression in South Korea has not been limited to attacks by the police on participants at the candlelight vigils. Information gathered shows that there is a trend towards restricting the media’s freedom of opinion and expression through the use of defamation laws. The Ministry for Food, Agriculture, Forestry and Fisheries, for example, has taken a number of actions against four producers of MBC TV's PD Notebook programme over a report it aired on April 29 this year about U.S. beef and mad cow disease. These actions include criminal and civil defamation cases and a complaint before the Press Arbitration Commission. Furthermore, the Korea Communications Commission (KCC) has ordered MBC TV to make a public apology for this programme.

경찰에 의한 표현의 자유 침해는 촛불집회 참가자들에게 국한되지 않았다. 수집된 정보에 따르면 형사상 명예훼손 관련법규로 언론의 의견개진 및 표현의 자유를 제한하려는 경향이 나타나고 있다. 예를 들면, 농식품부는 수차례에 걸쳐 지난 4월 29일 미국 소와 광우병 관련내용을 방송한 MBC TV PD수첩을 제작한 4명의 PD를 비난했다. 형사건과 명예훼손으로 고소하는 한편 언론중재위원회에 제소했다. 한국방송위원회(KCC)는 이 프로그램과 관련, 공개사과 하라는 결정을 내렸다.

The proposal of the Ministry of Justice to extend the coverage of criminal defamation laws to the internet is further cause for concern. This proposal goes against the global call to decriminalise defamation. Criminal defamation statutes are viewed as undue infringement of freedom of opinion and expression since they have often been used by governments to suppress political dissent and democratic discourse.

형사적 명예훼손 적용범위를 인터넷에까지 확장시키려는 법무부의 계획은 더욱 우려를 자아낸다. 이 계획은 명예훼손의 범위를 축소시키려는 국제적 요청에 반하는 것이다. 형사적 명예훼손은 정치적 반발과 민주적 여론을 억압하기 위한 정부의 도구로 사용돼 왔기 때문에 의사표현의 자유와 들어맞지 않는 것으로 간주된다.

The attempts to restrict and deny people's freedom of expression and the attacks against human rights defenders outlined in this submission mark a retreat from the gains that South Korea has made in the past two decades in promoting and protecting the human rights of its people. Both the ALRC and FORUM-ASIA over the years have held up South Korea as a country that has successfully made the difficult transition from a military regime to a democratic government that respects people’s rights. Now these hard-fought gains by the people of South Korea are in jeopardy of being reversed--concerns that are shared by many of the people that the mission interviewed.

시민의 표현자유를 제한하고 부정하며 인권옹호자들을 공격하려는 시도는 한국 시민들이 지난 20여년동안 이루어왔던 인권수호 및 증진 성과를 후퇴시키려는 징후로 보여진다. ALRC와 FORUM-ASIA은 한국을 군사정권에서 국민의 권리를 존중하는 민주적 정부로 성공적으로 이행시켜온 나라로 평가해왔다. 조사단이 면담한 많은 사람들은 지난한 투쟁을 통해 얻어진 성과가 거꾸로 가는 위험에 처해있다는 우려를 나타냈다.

Moreover, the South Korean government, as a member of the U.N. Human Rights Council, has a special responsibility to set a high standard for promoting and protecting human rights, including the freedom of expression of its citizens. At the present time, the South Korean government is not fulfilling this responsibility.

게다가 유엔 인권위원회 이사국인 한국은 시민들의 표현의 자유 등 인권증진과 옹호와 관련, 모범적인 기준을 제시할 책임이 있다. 현재 한국 정부는 이 의무를 이행하지 않고 있다.

To assist the South Korean government in realising this responsibility, the ALRC and FORUM-ASIA offer the following recommendations:

한국정부가 이 책임성을 인식할 수 있도록 ALRC와 FORUM-ASIA는 다음과 같이 권고한다:

a. Conduct investigations into allegations on attacks against demonstrators and human rights defenders and bring the perpetrators to justice;

시위대와 인권단체들에 대한 공격에 대해 조사하고 관련자를 처벌해야 한다.

b. Abolish the current system of conscripting young and poorly trained men into the riot police;

어리고 교육이 부족한 인원을 전경으로 차출하는 현재의 시스템을 폐지해야 한다.

c. Amend laws unduly restricting freedom of expression and assembly, particularly those provisions of the Act on Assembly and Demonstration which prohibit public assemblies after dark and which indirectly require a police permit to hold assemblies;

표현 및 집회의 자유를 과도하게 제한하는, 특히 일몰 이후에 집회를 금지함으로써 간접적으로 경찰이 참가자들을 체포할 수 있도록 한 법을 개정해야 한다.

d. Comply with international human rights standards and decriminalise defamation;

국제인권기준의 요구에 따라 명예훼손의 적용범위를 축소해야 한다.

e. Make human rights training mandatory for all police officers in accordance with international standards.

국제기준에 따라 모든 경찰관들이 인권교육을 받을 수 있도록 해야 한다.

A Statement by the Asian Human Rights Commission

SOUTH KOREA: Forcing female protesters in custody to remove their bras is a form of cruel and inhuman treatment

구금상태의 여성 시위자에게 강제로 브래지어를 벗도록 한 것은 잔인하고 비인간적인 처사이다.

For anyone who wonders which nation has the best police in the world, the following may give you an answer: the Korean police definitively protected at least six female protesters from committing suicide in custody by forcing them to remove their bras.

누군가 세계 제일의 경찰을 보유한 나라가 궁금하다면 아래 내용이 그 대답이 될 수 있을 것이다: 한국 경찰은 구금상태에 있던 최소 6명의 여성 시위자들의 브래지어를 강제로 벗게 함으로써 그들을 자살위험으로부터 확실히 지켜냈다.

According to information received by the Asian Human Rights Commission (AHRC), one 26-year-old female protester was arrested by the police. She was charged with violating the Act on Assembly and Demonstration, while attending the 100th candlelight protest held in Seoul on August 15. While putting her in the lock-up at the Mapo Police Station in Seoul, the police forced her to remove her bra, despite her repeated refusals. The police returned it to her only after a lawyer made a complaint about the incident on the morning of August 16. On the same night, other five female protesters were also forced to remove their bras in the Gangnam police station in Soul despite their refusal. These women stayed in the lock-up for about 40 hours without wearing a bra until they were released on August 17.

아시아인권위원회가 수집한 정보에 따르면, 26세의 한 여성 시위자가 경찰에 체포됐다. 그 여성은 지난 8월 15일 서울에서 열린 제 100회 촛불시위에 참가했다 집회 및 시위에 관한 법률 위반 혐의를 받고 있었다. 서울 마포 경찰서는 그 여성을 유치장에 가두면서, 그 여성이 거듭 거부의사를 밝혔음에도 불구하고 그 여성의 브래지어를 벗도록 강제했다. 한 변호사가 이 사건을 문제삼자 8월 16일 오전에야 브래지어를 그 여성에게 되돌려주었다. 같은 날 밤, 강남경찰서에서 다른 5명의 여성 시위자들도 거부의사를 밝혔음에도 불구하고 강제로 브래지어를 벗어야 했다. 이 여성들은 8월 17일 풀려날 때까지 40시간동안 브래지어를 착용하지 않은 채 유치장에 구금됐다.

The police justified their behavior saying that they did so according to the regulation to prevent them from committing suicide. Ironically, the police did not consider the facts that they are not serious criminals; have no previous record of attempting to commit suicide; no history of mental disease. Furthermore they would be released within 48 hours after their arrest. The regulation the police referred to says that the police may collect items such as a belt or a necktie “when there is a serious concern that an inmate may commit suicide or inflict injuries upon oneself”.

경찰은 자살방지 조항에 따랐을 뿐이라고 말하며 그들의 행위를 정당화했다. 아이러니컬하게, 경찰은 그 여성들이 중범죄자가 아니라는 사실; 자살 시도 전력이 없다는 사실; 정신병력이 없다는 사실 등을 고려하지 않았다. 또한 그 여성들은 48시간 이내에 구금에서 풀려나는 상황이었다. 경찰이 적용했던 그 규정은 “수용자가 자살을 시도하거나 자해할 심각한 우려가 있을 때” 벨트나 넥타이 등 물건을 압수할 수 있도록 하고 있다.

The police also claimed that they ask a woman to remove her bra in concern for her security in a situation where she would be detained over 48 hours or she would be detained in the lock-up alone. However, the AHRC confirmed that five women detained at the Gangnam police station were detained together with two others and were all released within 48 hours. The AHRC was also informed that the women were not violent nor did they show any psychological instability, whereupon the police would have to implement this regulation. It is reported that this inhuman practice is being implemented at considerable numbers of police stations in Seoul.

경찰은 또 여성이 48시간 이상 구금되거나 유치장에 혼자 구금될 수 있는 상황에서 여성들의 안전을 우려해 브래지어를 벗도록 요청했다고 주장했다. 하지만 아시아인권위원회는 강남 경찰서에 있었던5명의 여성들이 다른 2명과 함께 모두 함께 구금돼 있었으며 이들 모두 48시간 이내에 풀려난 사실을 확인했다. 이와함께 아시아인권위원회는 경찰이 이 규정을 적용할만큼 여성들이 폭력적이거나 어떠한 정신병리학적 불안정성을 보이지 않았다는 점 등에 대한 정보를 얻었다. 보도에 따르면 이런 비인간적인 조치는 서울의 여러 경찰서에서 자행됐다.

The AHRC is of the opinion that forcing the women inmates to remove their bras is cruel and inhuman treatment. It is prohibited by the International Covenant on Civil and Political Rights (ICCPR) and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) to which Korea is a state party. This is a good example that the Korean police arbitrarily implemented the regulation on the women arrestees beyond their mandate. It is also a clear form of sexual harassment violating the rights of women.

아시아인권위원회는 여성 수감자에게 강제로 브래지어를 벗도록 한 행위는 잔인하고 비인간적인 처사라는 점을 밝힌다. 이런 행위는 한국이 회원국으로 있는 시민적 정치적 권리에 관한 국제협약(ICCPR) 및 고문 및 그 밖의 잔혹한, 비인간적인 또는 굴욕적인 대우나 처벌의 방지에 관한 협약(CAT)에서 금지하고 있다. 이번 사건은 한국 경찰이 피체 여성들에 대해 그들의 권한을 넘어서서 이 규정을 임의 적용한 사례이다. 이는 또한 여성의 권익을 침해한 명백한 성희롱 형태이다.

After facing huge public criticism about the incidents, the police announced that they would review the relevant regulation to prevent similar incidents in the future. However, the police have made no official apology to the women concerned, nor have they taken disciplinary action against the responsible police officers. Instead, one senior investigating officer at the Gangnam police station reportedly told a local newspaper that the women concerned “voluntarily” removed their bras. He also said that if the women felt serious humiliation and claimed they would rather die than remove their bras, the police will not force them to do so. He further said that “a person’s life is the most important, rather than any of human rights”.

이 사건이 커다란 반향을 일으키자 경찰은 향후 이와 비슷한 사건을 방지하기 위해 관련 규정을 검토하겠다고 발표했다. 하지만 경찰은 관련 여성들에게 공식적인 사과도 하지 않았을 뿐 아니라 관련 경찰관들에 대한 징계도 하지 않았다. 대신, 보도에 따르면 한 고위 감찰관은 지역신문 기자에게 해당 여성이 “자발적으로” 브래지어를 벗었다고 말했다. 그는 또 그 여성이 심한 모욕감을 느꼈거나 브래지어를 벗느니 차라리 죽겠다고 항변했다면 경찰이 브래지어를 벗도록 하지 않았을 것이라고 말했다. 게다가 그는 또 “어떤 종류의 인권보다 한 사람의 생명이 중요하다”고 말했다.

The AHRC is delighted by the Korean police’s firm commitment to protect the lives of women. We may soon hear the news that the Korean government introduced a law prohibiting women from wearing a bra to protect their lives in near future.

The Korean police have shown a perverted enthusiasm in protecting public order and security as it continues action against the ongoing candlelight protests for over three months. On August 15, the police used colored water from movable water cannons to identify “illegal bad” candlelight protesters from “good” citizens and harass those whom they considered were disturbing public interest and order. Eventually, the police indiscriminately arrested 157 persons within one night. The Korean government has forgotten that those protesting and those arrested are also citizens of Korea and they have the freedom of assembly guaranteed under Article 21 of the Constitution of Korea and Article 21 of the ICCPR.

아시아인권위원회는 여성의 생명을 보호하려는 경찰의 확고한 태도를 기쁘게 받아들인다. 우리는 조만간 한국정부가 여성들의 생명을 보호하기 위해 브래지어 착용을 금지하는 법안을 도입한다는 뉴스를 접할 것 같다. 한국 경찰은 3개월 이상 지속되고 있는 촛불시위로부터 공공의 질서와 안녕을 보호하기 위해 일련의 행위들을 통해 변태적인 의욕을 보여주고 있다. 8월 15일, 경찰은 “선량한” 시민들로부터 “범법” 촛불시위자를 찾아내고 공공의 이해와 질서를 어지럽힌다고 여겨지는 범법자들을 검거한다며 살수차를 동원해 색소가 담긴 물을 살포했다. 결국 이날 하루밤 사이에 경찰은 무차별적으로 157명을 체포했다. 한국 정부는 그 시위대들과 피체된 사람들도 역시 한국 시민들이며 한국 헌법 21조 및 시민적 정치적 권리에 관한 국제협약(ICCPR) 21조에 보장된 집회의 자유를 갖고 있다는 점을 망각하고 있다.

The AHRC is also gravely concerned by reports from Korean civic groups that the police did not follow the Miranda rule and used excessive force in several cases at the times of arrest. The groups further said that the police indiscriminately arrested anyone whose clothes were colored by water cannons, without confirming whether they participated in the protest or not.

아시아인권위원회는 또한 체포 당시 경찰이 미란다 원칙을 고지하지도 않았을 뿐 아니라 과도한 물리력을 사용했다는 한국 시민단체들의 문제제기에 심각한 우려를 표한다. 이 시민단체들은 또한 경찰이 색소 물대포로 옷에 물감이 든 사람이면 그가 시위에 참가했는지 여부를 확인하지도 않고 무차별 체포했다고 밝히고 있다.

The National Human Rights Commission of Korea decided, on July 11, to have a suo motu inquiry into the allegations of excessive use of force by the police and the violation of the rights of candlelight protesters. The NHRC has the power, in defending the human rights of citizens, to take notice on its own, of serious human rights violations, even though no complaints are received. Before the NHRC made this decision, all 14 members of the Human Rights Advisory Committee of the Korean National Police Agency resigned this June, as a symbolic action, to demonstrate their strong protest and concern over the excessive use of force by police in handling the candlelight protesters. Regardless, the use of excessive force on protestors by the Korean police has not decreased at all and in fact is escalating. This raises serious concerns about the Korean government’s commitment to human rights as an elected member of the U.N. Human Rights Council.

한국 국가인권위원회는 7월 11일, 경찰의 과도한 물리력 남용 및 촛불시위자들에 대한 권리 침해에 관해 자체조사를 벌이기로 결정했다. 국가인권위원회는 시민들의 인권보호를 위해, 별도의 진정이 제기되지 않았더라도 심각한 인권침해에 대해 자체 인지할 권한을 가지고 있다. 지난 6월 국가인권위원회의 이 결정이 있기 전, 경찰 인권 자문위원회 위원 14명 전원은 촛불시위를 대하는 경찰의 과도한 공권력 남용에 대한 강력한 항의를 보여주기 위한 상징적 행동으로 자문위원을 사퇴했다. 그럼에도 불구하고 시위자들에 대한 경찰의 과도한 물리력은 줄어들기는커녕 오히려 점점 더 심해졌다. 이는 유엔인권위원회 선출이사국으로서의 한국의 책임과 관련, 심각한 우려를 불러일으키고 있다.

Until very recently, Korea was not only a successful economic model but also a successful model of democracy and human rights in the Asian region. Democracy in the country today has been achieved at the expense of the lives of many Korean citizens. Unfortunately, events such as those mentioned above are holding Korea back from moving towards greater democracy and human rights.

최근까지 한국은 아시아 지역에서 성공한 경제 모델로서뿐만 아니라 성공한 민주주의, 성공한 인권국가의 모델이었다. 오늘날 한국의 민주주의는 수많은 시민들의 값진 희생으로 열매 맺어진 것이다. 불행하게도, 위에 언급한 사건들은 더 위대한 민주주의, 더 위대한 인권 공동체로 나가려는 한국을 후퇴시키고 있다.

The AHRC strongly urges the Korean government to make an official apology to the women concerned and take necessary and immediate action to prevent ill-treatment of protesters at the time of their arrest and while in police custody. We also demand that the Korean government stop using arbitrary and excessive force to repress peaceful protesters. The Act on Assembly and Demonstration, which has been seen as excessively limiting the right of assembly, should be amended. The Act should meet international human rights standards and its arbitrary implementation for protesters should be restricted. We also demand that the Government immediately conduct a full inquiry into the violent acts of the police force and hold these responsible to account according to the law.

아시아인권위원회는 관련여성들에게 공식사과하고 시위자 체포 및 구금시 부당한 대우를 방지할 수 있는 필요하고도 즉각적인 조치를 취할 것을 한국 정부에 강력하게 촉구한다. 우리는 또한 평화적 시위대를 진압하기 위한 임의적이고 과도한 물리력 행사를 중지할 것을 한국 정부에 요구한다. 집회의 권리를 과도하게 제한하고 있는 집회 및 시위에 관한 법률은 개정되어야 한다. 이 법은 국제 인권 규범의 요구와 부합해야 하며 시위자들에 대한 임의 적용은 지양되어야 한다. 우리는 또한 정부가 즉각 경찰력의 불법행위에 대한 일제 조사를 실시, 관련자들을 법에 따라 처리할 것을 요구한다.

SOUTH KOREA: Amnesty to convicted frauds and tax evaders will undermine the Korean judiciary and the morale of the people

사기 및 세금포탈 사범에 대한 사면은 한국 사법체계와 국민의 도덕성을 저해할 것이다

The granting of amnesties by the president to a number of tycoons, who were convicted by the Korean courts after affording them fair trial, will have the impact of creating the impression that the executive is undermining the judiciary. It will also push back the long and arduous struggle of the people to develop a rule of law system within the country. When politicians of a rival political party, when in power can override the judgements of the courts, it passes a message of the politicisation of the justice and judicial process. Within a few months of coming to power the present regime has dealt a serious wound to the very fabric of the modern democratic system of Korea, which if not cured as urgently as possible, may infect the entire system.

공정거래를 위반한 혐의로 한국법원에 의해 유죄판결을 받은 재벌들에 대한 대통령 사면은 행정부가 사법부(의 권위)를 저해시키고 있다는 인상을 남기는 효과를 가져올 것이다. 또한 ‘법에 의한 지배’라는 체계를 발전시켜온 한국민들의 장기간에 걸친 지난한 투쟁을 후퇴시키게 될 것이다. 경쟁하고 있는 정당의 정치인이 권력을 쥐었을 때, 법원의 판결을 유린할 수 있게 됐을 때, 권력은 ‘정의와 사법절차의 정치수단화’라는 메시지를 묵인한다. 집권 수개월만에 이명박 정권은, 긴급하게 치유되지 않는다면 전체 체계에 악영향을 미칠 정도로 한국의 현대 민주주의 체계의 근간을 심각하게 손상시켰다.

Korea acquired a prestigious place in 1987 by its rapid and remarkable developments towards the strengthening of the democratic institutions of the country and undoing the extreme abuses of power exercised by the executive through ruthless and brutal military regimes. The historic moment at which this determination was shown was when the Korean courts convicted two former presidents for various crimes which included the causing of a massacre and corruption. That was an extremely significant moment since at that point Korea entered the age of maturity as a democracy by subordinating the executive to the judicial process and the decisions of the judiciary.

한국은 지난 1987년 빠르고 경이롭게 민주주의적 제도를 강화시키는 한편 무자비하고 야만적인 군사독재 정권 행정부에 의해 자행됐던 극단적 권력 남용을 단죄함으로써 (민주주의 역사에서) 독보적인 위치를 차지했다. 이 같은 결정이 보여졌던 역사적 순간은 한국 법원이 두 전직 대통령을 학살 및 부패 등 혐의로 유죄판결을 내렸을 때였다. 이는 지극히 의미심장한 순간으로 이 시점에서 한국은 행정부를 사법절차 및 법원의 판결에 복속시키는 민주주의 성숙단계로 접어들었기 때문이다.

The sign of a functioning democracy is the strength of the people to express themselves against their government in a peaceful manner. The Korean achievements since 1987 were a manifestation that the people of Korea have come to a position of strength and were not slaves of a dictatorial state. The sign of that power is the ability to control powerful business establishments and to bring them under the law. The ultimate strength of a democracy lies in the ability of a system to control abuse of power and corruption. Sadly, within a period of less than six months the present regime has undermined all these achievements and disgraced the democracy of Korea.

기능하고 있는 민주주의는 평화적인 방법으로 정부에 대해 스스로를 표현할 수 있는 시민들의 힘이 있는지 여부로 확인할 수 있다. 지난 1987년 이래 한국이 이루어낸 업적은 한국 국민이 이 같은 힘을 쟁취한 위치에 올랐고 독재체제의 노예가 아니라는 사실을 보여주는 것이었다. 이 같은 힘은 힘있는 경제집단을 통제하고 법(의 지배) 아래 종속시키는 능력으로 나타났다. 민주주의의 궁극적 힘은 권력 남용과 부패를 통제할 시스템의 능력에 있다. 유감스럽게도, 6개월이 채 되기도 전에 이명박정권은 이 모든 업적들을 훼손하고 한국 민주주의의 명예를 손상키켰다.

The argument that convicted prisoners are needed for the purpose of economic development is a shameless political statement. If the present regime believes that without persons convicted of fraud and tax evasion it cannot ensure economic development the regime’s message on that score will, among other things, damage the economic development itself. This is like putting a cat in with the pigeons under the pretext that the pigeons need exercise. Everyone who has an inclination to be corrupt and evade paying their taxes will now find that the new regime is encouraging them to do so. Corruption, when encouraged can spread so fast as to be beyond the imagination. When corruption spreads like that it infects the civil service and all the institutions of governance. We give below a list of the persons who have been given amnesty by the new regime who have originally been convicted by courts on fraud and tax evasion.

유죄판결을 받은 수인들이 경제성장이라는 목적에 필요하다는 논거는 후안무치한 정치적 수사이다. 이명박정권이 사기 및 세금포탈로 유죄판결을 받은 인물들이 없이는 경제성장을 확신할 수 없다고 믿는다면, 이명박 정권의 메시지는 무엇보다도 바로 그 점 때문에 경제성장 자체를 망치게 될 것이다. 이는 비둘기에게 운동이 필요하다는 핑계로 고양이를 (비둘기 새장에) 함께 두는 꼴이나 다름없다. 부패성향이 있거나 세금을 피하고자 하는 사람이라면 이제 이 정권이 그런 행위들을 조장하는 것으로 알게 될 것이다. 부패는, 한번 힘을 얻게 되면 상상을 초월할 정도로 빠르게 확산된다. 이처럼 부패가 확산되면 공공 서비스 부문과 모든 정부 기관들에 악영향을 미친다. 사기 및 세금포탈로 법원에 의해 유죄판결을 받았다 이명박 정권에 의해 사면된 인물들의 명단을 밝힌다.

1) Mr. Choi Tae-won, CEO from SK company was convicted of window-dressing worth a trillion 558,700 million (USD 1,507,886,341)

1) 최태원, 1조 5천5백87억원(USD 1,507,886,341) 분식회계 혐의로 유죄판결을 받은 SK 그룹 CEO.

2) Mr. Jeong Mong-gu, CEO from Hyundai-Kia motors was convicted of usurpation worth 100,000 million (USD 96,739,998)

2) 정몽구, 1천억원(USD 96,739,998) 유용 혐의로 유죄판결을 받은 현대-기아 자동차 CEO.

3) Mr. Kim Seung-youn, CEO from Hanwha Company is included; His son was beaten and he called thugs to avenge the man who had beaten his son. He is given amnesty because he is CEO.

3) 김승연, 한화 CEO; 폭력배를 사주해 아들 폭행자에게 복수. 그는 CEO이라는 이유로 사면됐다.

4) Mr. Yang Yun-jae, former deputy Seoul mayor was convicted and punished with 5 years imprisonment and 255,000,000 KRW (USD 246,687) as a forfeit by Supreme Court in 2006. Mr. Yang worked for developing Cheonggye stream with the President when the President served as a Mayor in Seoul.

Mr. Son Gil-seong, former CEO from SK company, Mr. Choi won-seok, former CEO from Dong-A Construction, Mr. Kim Yun-gyu, former representative from Hyundai Construction and Mr. Choi Soon-young, former CEO from New Dong-A group. Total number of businessmen received amnesty is 74.

4) 양윤재, 전 서울 부시장, 2006년 대법원으로부터 징역 5년 및 벌금 2억5천5백만원(USD 246,687)을 선고받음. 양전부시장은 이대통령이 서울시장 재임시 청계천 개발에 참여했음.

손길승, 전 SK CEO, 최원석, 전 동아건설 CEO, 김윤규, 전 현대건설 대표, 최순영, 전 신동아 그룹 CEO, 사면된 기업가 총 인원은 74명.

The list of newspapers that have supported the president during the presidential election and used to write articles for the government is as follows.

대선기간 중 이대통령을 지지했고 현정부에 우호적인 기사를 쓰는 신문 목록은 다음과 같다.

Politicians and those who were convicted of violation of election act also received amnesty. Those are about 2,000.

정치인 및 선거사범 역시 사면됐다. 그 수는 약 2,000명이다.

Public officials who were given departmental punishment before the new government also received amnesty. The number is about 341,000.

새 정부 출범 이전 직무상 처벌을 받았던 공무원들도 사면됐다. 약 341,000명.

The examples of countries that have developed economically in the Asian region show that one of the most important reasons for their success has been the effective elimination of corruption. The Independent Commission against Corruption in Hong Kong has been the basis for the dynamic developments of that territory. If an amnesty like the one which was given by the new regime of Korea is proposed by any administration in Hong Kong without doubt there would be an enormous social revolt. Many persons who have in any way tried to interfere with the proper implementation of the laws relating to corruption have lost their jobs as people value their achievements in the control of corruption.

아시아 지역에서 경제적으로 발전을 이룬 나라들의 사례는 가장 중요한 성공의 이유가 효과적인 부패 척결이라는 점을 보여준다. 홍콩 반부패 독립 위원회는 해당 지역내 역동적인 발전의 토대가 됐다. 만일 이 지역 내에서 한국에서처럼 행정부에 의한 사면이 이뤄졌다면, 엄청난 반발이 나타났을 것이라는 점은 의심할 여지가 없다. 부패 통제에 대한 업적을 스스로 가치있게 만든 인민들이 있었기 때문에, 부패와 관련, 정당한 법 집행을 어떤 식으로든지 유린하려던 많은 사람들이 그들의 일자리를 잃었다.

SOUTH KOREA: Massive arrest against protesters is imminent

Since the government of South Korea agreed with the United States of America to import beef on April 17, the people of the South Korea have expressed their deep concerns about the agreement due to the reports of bovine spongiform encephalitis (mad cow disease) having been found in the U.S. The failure of both governments to give reassurances on the condition of the beef has done nothing to assuage the people’s fears. Mad cow disease is a deadly disease for which there is no known cure. It may lay dormant in the infected person for years before symptoms are revealed or felt.

지난달 17일 한국 정부가 미국 쇠고기를 수입하기로 합의한 이래 한국민들은 미국에서 광우병이 발생했다는 보고 때문에 협정에 대해 깊은 우려를 나타내고 있다. 양국은 쇠고기 상태에 대해 안심시키는데 실패함으로써 국민들의 우려를 불식시키지 못했다. 광우병은 아직 치료방법이 밝혀지지 않은 치명적인 병이다. 광우병은 감염되면 수년간의 잠복기를 거쳐 증상이 나타난다.

In the hope that the government will accept the people's demands, tens of thousands of people, composing of family members including school students, have voluntarily come before the Cheonggyechoen (Cheonggye stream), Seoul, in a candlelight vigil, asking the government to renegotiate the agreement and stop importing beef from the U.S. until the people of South Korea are assured that it is free of the disease. The people have held candlelight vigils, not on-ly in the capital Seoul, but also in major cities across the country for the last 17 days.

정부가 국민들의 요구를 받아들이기를 바라면서 학생을 포함한 가족단위의 국민들 수만명이 청계천에 자발적으로 모여 쇠고기 수입에 대해 재협상하고 국민들이 이 광우병으로부터 완전히 자유로워질 때까지 수입을 중단할 것을 요구하며 촛불시위를 벌이고 있다.

Students from middle schools and high schools have been reportedly prohibited from taking part in the vigils and several teachers were dispatched in order to identify their students wearing school uniform. It is also reported that school principals have publicly announced suspensions of students and announced the prohibition of other students from taking part. The students submitted a complaint to the National Human Rights Commission of Korea regarding the restriction of freedom of expression and assembly.

소식에 따르면 중고생들이 이 시위에 참여하는 금지돼있고 몇몇 학교들은 교사들을 보내 교복을 입은 학생들을 찾아내고 있다는 것. 또 다른 소식에 따르면 몇몇 교장들은 공개적으로 참가학생들을 정학시키겠다며 다른 학생들이 집회에 참여하지 못하게 하겠다고 공언하고 있다. 학생들은 표현과 집회의 자유를 제한하는 것과 관련, 국가인권위원회에 제소하기도 했다.

Due to pressure from the people, including students, the government has postponed the public announcement, which will be effective immediately on-ce it is made. However, it is reported that it will be announced either tomorrow or the day after tomorrow, (May 27 or 28). Being frustrated, some of protesters started to march on the street, which is illegal under the domestic law called the Act on Assembly and Protest after the candle light vigil on May 24. In response the riot police used their police shields to attack the peaceful marchers at 4am, May 25. It is reported that at about 68 protesters have so far been arrested and several were injured at the time. It is also reported that in Cheonbuk province, Mr. Lee Byung-Ryeol set fire to himself, shouting against the agreement on May 25 and his condition is currently serious. In the meantime, the Minister of Justice Mr. Kim Kyung-han has already proclaimed that the police will arrest protesters at any future demonstration.

학생들을 포함한 국민들의 압력으로 정부는 일단 진행되면 즉시 효력을 발휘하도록 돼 있는 고시를 연기했다. 하지만, 소식에 따르면, 정부는27일이나 28일쯤 고시를 진행할 방침이다. 이에 분노한 시위대는 24일 촛불문화제가 끝난 뒤 현행법상 집시법 위반인 거리행진을 시작했다. 이에대해 전투경찰은 25일 새벽 4시께 평화적으로 행진하고 있는 시위대에게 방패공격을 감행했다. 소식에 따르면 당시 약 68명이 체포되고 다수가 부상을 당했다. 또 25일 전북지역에서 이병렬씨가 쇠고기 협의에 반대하는 구호를 외치며 분신을 시도, 현재 중태이다. 한편 김경한 법무장관은 향후 시위 참가자들을 체포하겠다고 밝혔다.

The Asian Human Rights Commission urges the government of the South Korea to release the arrestees without condition and guarantee the right of peaceful assembly of the people which is enshrined in the Korean Constitution as well as International Covenant on Civil and Political Rights (ICCPR), to which the South Korea is a state party. It also urges that the government must ensure the safety and freedom of the people who take part in the candlelight vigil that is to be held tonight and in the future, and that it must guarantee the right of peaceful assembly in such a way as to protect protesters. Finally the AHRC calls upon the government to amend the Act on Assembly and Protest in compliance with the Constitution as well as international standards.

아시아인권위원회는 한국정부가 회원국으로 있는 시민적 및 정치적 권리에 관한 국제협약 (ICCPR)뿐만 아니라 한국헌법에도 보장된 평화적 집회에 관한 권리에 따라 무조건 연행자들을 석방할 것을 촉구한다. 또한 아시아인권위원회는 한국정부가 오늘 밤 및 앞으로의 집회 참석자들의 안전과 자유를 보장할 것, 시위대를 보호하는 방식으로 평화집회의 권리를 보장할 것을 촉구한다. 마지막으로 아시아인권위원회는 국제규범과 한국헌법에 부응하는 방향으로 집회 및 시위에 관한 법률을 개정할 것을 한국 정부에게 요청한다.
